He refuses to cooperate with the CIA (the successor to his former employer, the OSS) when they attempt to get him to breach attorney-client privilege. Though Abel is convicted, Donovan persuades the judge to spare him from the death penalty, arguing that Abel had been acting in service to his country and might one day be valuable in a prisoner exchange. Abel is sentenced to 30 years in prison. Donovan appeals the conviction to the Supreme Court, citing the absence of a proper search warrant for the seizure of Abel’s ciphers and photographic equipment.
