In 1957 New York City, Rudolf Abel is arrested and charged with espionage for the Soviet Union. Lawyer James B. Donovan, a former general counsel to the Office of Strategic Services (OSS), now working in private insurance law, is appointed as Abel’s defense attorney. Despite the pressure, Donovan is committed to the principle that every accused person deserves a strong defense. He refuses to cooperate with the CIA (the successor to his former employer, the OSS) when they attempt to get him to breach attorney-client privilege. Though Abel is convicted, Donovan persuades the judge to spare him from the death penalty, arguing that Abel had been acting in service to his country and might one day be valuable in a prisoner exchange. Abel is sentenced to 30 years in prison. Donovan appeals the conviction to the Supreme Court, citing the absence of a proper search warrant for the seizure of Abel’s ciphers and photographic equipment. As a result of his principled stance, Donovan and his family face harassment, including gunfire directed at their home. The Supreme Court ultimately upholds the conviction by a narrow margin.

In 1960, Francis Gary Powers, a CIA pilot in the covert U-2 spy plane program, is shot down over Soviet territory and captured. He is sentenced to ten years’ imprisonment, including three years in prison. Shortly afterward, Donovan receives a letter, allegedly from Abel’s wife, thanking him and asking him to contact a lawyer named Vogel. The CIA believes this is a covert signal indicating that the Soviet Union is open to a prisoner exchange: Powers for Abel. They unofficially ask Donovan to negotiate the deal in Berlin, where he arrives just as the Berlin Wall is being erected. In East Berlin, Donovan meets with a KGB officer at the Soviet Embassy, who directs him to Vogel. Vogel represents the Attorney General of East Germany, who proposes exchanging Abel for Frederic Pryor, an American graduate student arrested by East German authorities. The GDR hopes to use the exchange to gain diplomatic recognition from the United States.
